ADVERTISEMENT FOR BIDS
Sealed bids for Rogers Ped. Impvts. (TAP-19) (S), to be constructed for the City of Rogers will be received at the City of Rogers Clerk’s Office, addressed to 301 W Chestnut Street, Rogers, AR 72756, and via electronic bidding through Centralbidding.com until 2 P.M. on Tuesday, March 29nd April 5, 2022, at which time the bids shall be publicly opened and read aloud in the City of Rogers Community Room and via zoom at https://us02web.zoom.us/j/84977762537. The envelope containing the bid should be marked “Bid for ROGERS PED. IMPVTS. (TAP-19) (S)”. 

A mandatory Pre-Bid Conference will be held on 2 P.M. on Tuesday, March 15th, 2022, at the City of Rogers Community Room. Each bidder shall be limited to three personnel per organization.  Attendees are encouraged to join virtually via a link that will be available to plan holders. 
 
The project consists of pedestrian facility improvements for fourteen (14) elementary and middle schools located in the City of Rogers. This includes improvements to pavement marking and signage with approximately 900-ft of sidewalk extensions.
 
Bids will be received for a single prime contract. Bids shall be on a unit price basis as indicated in the Bid Form.

The City of Rogers hereby notifies all bidders that this contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Act of 1938. The Work Hours Act of 1962 and Title VI of the Civil Rights Act of 1964 also apply.
 
Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting.  For more information please refer to www.wdol.gov.
 
“Buy America” provisions apply to this project. The Arkansas State Highway and Transportation Department’s Standard Specifics Section 106 has requirements and restrictions for Buy America. Also, 23 CFR § 635.410 has all the federal requirements for Buy America.
 
The City of Rogers encourages all qualified small, minority-owned, and women-owned business enterprises to bid on and receive contracts for goods, services, and construction. Also, the City of Rogers encourages all general contractors to subcontract portions of their contract to qualified small, minority-owned, and women-owned business enterprises.
 
Bids shall be accompanied by a certified check, bank money order, or a Bid Bond (on the form included in the Bidding Documents) issued by a surety meeting the requirements of Paragraphs 6.01 and 6.02 of the General Conditions, in an amount of five percent (5%) of the total maximum bid price payable without recourse to the Owner, as a guarantee that the Bidder will enter into a contract and execute performance and payment bonds within fifteen (15) days after notice of award of Contract to him. Such bid guarantee shall be made payable to the City of Rogers.
 
The successful bidder must furnish a performance, payment, and maintenance bond upon the form provided in the amount of one hundred percent (100%) of the contract price from an approved surety company holding a permit from the State of Arkansas to act as surety, or other surety or sureties acceptable to the Owner.
 
Bids must remain in effect for 120 days after the bid opening date. Within 120 days from the bid date, the Owner may award the contract to the lowest responsive, responsible bidder or reject any or all bids for the project.
 
The City of Rogers reserves the right to reject any or all bids, to waive irregularities in the bids and bidding deemed to be in the best interests of the City of Rogers, and to reject nonconforming, nonresponsive, or conditional bids.
